1. Introduction

Welcome to phtay. These Terms and Conditions ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "Player," "you") and phtay ("phtay," "we," "us," "our"), the operator of the online gaming platform accessible at phtay.net and its associated subdomains and mobile interfaces.

By accessing the phtay website, creating a phtay account, using the phtay Login portal, or participating in any game, promotion, or service offered by phtay, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with phtay's Privacy Policy and Responsible Gaming Policy, which are incorporated herein by reference.

2. Eligibility

2.1 Age Requirement

You must be at least twenty-one (21) years of age to register for a phtay account and use any phtay service. This age requirement is mandated by Philippine gambling regulations. phtay strictly enforces this requirement and conducts age verification using valid Philippine government-issued identification documents.

2.2 Geographic Eligibility

phtay's services are intended for use by residents of the Philippines. By using phtay, you represent and warrant that you are physically located in a jurisdiction where online gaming is lawful and that your use of phtay does not violate any applicable local, national, or international law or regulation.

2.3 Prohibited Persons

The following persons are not eligible to register or maintain a phtay account:

Persons under 21 years of age;
Persons who have previously been excluded or banned from phtay or any affiliated platform;
Persons who have voluntarily self-excluded through phtay's responsible gaming tools;
Employees, contractors, directors, or officers of phtay or its affiliates, and their immediate family members;

            Zero Tolerance for Underage Gambling: phtay has a strict zero-tolerance policy for underage gambling. Any account found to be operated by a person under 21 years of age will be immediately suspended, all winnings forfeited, and deposits returned in accordance with applicable law. phtay may report such instances to the relevant Philippine authorities.
          

3. Account Registration & Security

3.1 One Account Per Person

Each individual may hold only one (1) phtay account. Creating multiple accounts — whether under the same name, different names, or using different devices, email addresses, or payment methods — is strictly prohibited. phtay reserves the right to close all duplicate accounts and forfeit any balances held therein.

3.2 Accurate Information

You agree to provide accurate, current, and complete information during the phtay registration process and to update such information promptly if it changes. phtay may require you to verify your identity at any time by submitting a valid Philippine government-issued ID (e.g., PhilSys National ID, passport, driver's license, SSS/GSIS ID, PRC ID, or voter's ID).

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your phtay Login credentials, including your username and password. You agree to:

Use a strong, unique password for your phtay account;
Enable two-factor authentication (2FA) via SMS where available;
Never share your phtay Login credentials with any other person;
Notify phtay immediately if you suspect unauthorized access to your account;
Log out of your phtay account after each session, especially on shared devices.

phtay shall not be liable for any loss or damage arising from your failure to maintain the security of your phtay Login credentials.

3.4 Account Verification (KYC)

phtay is required to conduct Know Your Customer (KYC) verification in accordance with Philippine anti-money laundering regulations. You agree to submit requested identity documents within the timeframe specified by phtay. Failure to complete KYC verification may result in suspension of withdrawal privileges or account closure.

4. User Conduct & Prohibited Activities

By using phtay, you agree not to engage in any of the following prohibited activities:

Fraud and Cheating: Using any software, algorithm, bot, script, or other automated tool to gain an unfair advantage in any phtay game;
Collusion: Coordinating with other players to manipulate game outcomes in live dealer or multiplayer games;
Bonus Abuse: Exploiting phtay promotions through the creation of multiple accounts, use of false information, or any other deceptive means;
Money Laundering: Using phtay for any money laundering, terrorist financing, or other financial crime in violation of Philippine law, including Republic Act No. 9160 (Anti-Money Laundering Act) as amended;
Unauthorized Access: Attempting to gain unauthorized access to phtay's systems, servers, databases, or other users' accounts;
Misrepresentation: Providing false identity information or impersonating any person or entity;
Harassment: Engaging in abusive, threatening, or harassing behavior toward phtay staff or other users.

phtay reserves the right to investigate suspected violations and to take appropriate action, including immediate account suspension, forfeiture of balances, and referral to Philippine law enforcement authorities.

5. Deposits & Withdrawals

5.1 Accepted Payment Methods

phtay accepts deposits and processes withdrawals exclusively in Philippine Peso (₱) through the following payment methods: GCash, PayMaya/Maya, and bank transfers via BPI, BDO, Metrobank, UnionBank, Landbank, PNB, Security Bank, and debit cards issued by Philippine banks.

            Prohibited Payment Methods: phtay does not accept cryptocurrency of any kind (including but not limited to Bitcoin, Ethereum, USDT, or any other digital asset) for deposits or withdrawals. Credit card gambling deposits are not permitted in accordance with Philippine regulations. Any attempt to fund a phtay account using prohibited payment methods will result in the transaction being declined and may trigger an account review.
          

5.2 Deposit Terms

The minimum deposit amount is ₱100. Deposits are generally credited to your phtay account within minutes of confirmation. phtay does not charge fees on deposits, though your payment provider may apply their own transaction fees. You are responsible for any fees charged by your bank or e-wallet provider.

5.3 Withdrawal Terms

Withdrawal requests are processed within one (1) to three (3) business days, subject to completion of KYC verification. The minimum withdrawal amount is ₱500. phtay reserves the right to request additional documentation before processing any withdrawal. Withdrawals will be returned to the same payment method used for the original deposit where technically possible.

5.4 Account Balance

Your phtay account balance is held in Philippine Peso and is not an interest-bearing account. phtay maintains player funds separately from operational funds. Inactive accounts (no login for 12 consecutive months) may be subject to a monthly dormancy fee of ₱50, applied until the balance reaches zero or the account is reactivated.

6. Bonuses & Promotions

phtay offers various bonuses and promotional offers to eligible players. All bonuses are subject to specific terms and wagering requirements published on the relevant promotion page. General bonus terms include:

Bonuses are available to verified phtay account holders aged 21 and above;
Each promotion specifies its own wagering requirement, minimum deposit, eligible games, and expiry period;
Bonus funds must be wagered the specified number of times before any associated winnings can be withdrawn;
phtay reserves the right to modify, suspend, or cancel any promotion at any time with reasonable notice;
Bonus abuse, including the use of multiple accounts to claim the same promotion, will result in forfeiture of all bonus funds and associated winnings;

7. Games & Fairness

In the event of a technical malfunction during any game, phtay reserves the right to void the affected round and return stakes to the players involved. phtay's decision regarding technical malfunctions is final. 9. Intellectual Property

All content on the phtay platform — including but not limited to the phtay brand name, logo, website design, graphics, text, software, game interfaces, and promotional materials — is the exclusive property of phtay or its licensors and is protected by applicable Philippine and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the phtay platform solely for your personal, non-commercial entertainment purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any phtay content without prior written permission from phtay.

10. Limitation of Liability

To the maximum extent permitted by applicable Philippine law, phtay, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the phtay platform, including but not limited to:

Loss of gaming funds due to technical malfunction, internet connectivity issues, or force majeure events;
Unauthorized access to your phtay account resulting from your failure to maintain credential security;
Decisions made by you based on information provided on the phtay platform;
Interruption or unavailability of the phtay service for any reason.

phtay's total aggregate liability to you for any claim arising under these Terms shall not exceed the total amount deposited by you into your phtay account in the thirty (30) days preceding the event giving rise to the claim.

            Disclaimer: The phtay platform is provided on an "as is" and "as available" basis. phtay makes no warranties, express or implied, regarding the uninterrupted availability, accuracy, or fitness for a particular purpose of the platform or any game offered thereon.
          

11. Termination & Account Closure

phtay reserves the right to suspend, restrict, or permanently close any phtay account at its sole discretion, with or without prior notice, in the event of:

Breach of any provision of these Terms;
Suspected fraud, cheating, collusion, or money laundering;
Failure to complete KYC verification within the required timeframe;
Provision of false or misleading information during registration or verification;
Regulatory requirement or instruction from a competent Philippine authority.

You may close your phtay account at any time by contacting phtay customer support. Upon voluntary account closure, any remaining balance (after deduction of applicable fees and pending bonus wagering requirements) will be returned to your registered payment method within ten (10) business days.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or your use of the phtay platform shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

Before initiating any formal legal proceedings, you agree to first contact phtay's customer support team to attempt to resolve the dispute informally. phtay will endeavor to respond to all formal complaints within five (5) business days.

13. Amendments to These Terms

phtay reserves the right to amend, update, or replace these Terms at any time. When material changes are made, phtay will notify registered users via email or a prominent notice on the phtay platform at least seven (7) days before the changes take effect, where practicable.

Your continued use of the phtay platform after the effective date of any amended Terms constitutes your acceptance of the revised Terms. If you do not agree to the amended Terms, you must cease using phtay and may request account closure in accordance with Section 11.
